Michael J. DelTergo joined Cohen, Weiss and Simon, LLP in December 2022 as Of Counsel in the Employee Benefits group. Mr. DelTergo is an experienced attorney who represents multiemployer plans exclusively and has over twenty-five years of diverse experience in ERISA compliance and litigation, nonprofits, federal and state tax law, estate and trust planning, and bank regulation.
Before joining Cohen, Weiss and Simon, Mr. DelTergo worked for Philadelphia and New Jersey union-side and employee benefit firms where he represented local and international multiemployer pension plans, welfare benefit plans and nonprofits in plan design & compliance matters, delinquency litigation, withdrawal liability, voluntary correction filings, subrogation, nonprofit formation and compliance, and general tax matters. He also has advised plan administrators for midsized and large companies and nonprofits on their qualified and nonqualified plans and worked in the banking regulation practice of a firm where he practiced before state and federal banking regulators.
Mr. DelTergo clerked for the Hon. Anne Thompson at the U.S. District Court for the District of New Jersey, and the Hon. Lynn Bush at the U.S. Court of Federal Claims. He also worked in the trust banking industry prior to entering the practice of law.
Mr. DelTergo received his J.D. from Suffolk University Law School, magna cum laude, in 1997 and received his LL.M. in taxation from New York University School of Law in 2005. He is also a graduate of the University of Massachusetts in Amherst.
